  19. WAIVER

    Sportsmanship Agreement: I hereby, via declaration of my signature, understand and accept responsibility for myself,  my child, family members, and other invited guests',  behavior in any Carteret County Parks & Recreation program. I understand that behavior such as taunting, fighting, attempting to strike other players, officials, and staff; arguments with officials and staff, abusive language (cursing) and other forms of unsportsmanlike conduct are not tolerated nor allowed and such behavior can and will result in suspension and possible expulsion of my child from the program with no refund. 

    Disclaimer: Carteret County Parks & Recreation is not responsible for any injury (or loss of property) to any person suffered while participating in any Carteret County Parks & Recreation sponsored program for any reason whatsoever, including ordinary negligence on the part of Carteret County Parks & Recreation, its agents or employees. In consideration of my participation, I hereby release and covenant not to sue Carteret County Parks & Recreation, Carteret County Board of Commissioners and any of their employees, instructors or agents from any and all present and future claims resulting from ordinary negligence on the part of Carteret County Parks & Recreation or others listed for property damage, personal injury or wrongful death, arising as a result of my engaging or receiving instruction in any Carteret County Parks & Recreation sponsored program incidental thereto, wherever, whenever or however the same may occur. I hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by me, my family, estate, heirs or assigns. I further agree to indemnify and hold harmless Carteret County Parks & Recreation and others listed for any and all claims arising as a result of my engaging in or receiving instruction in any Carteret County Parks & Recreation sponsored program incidental thereto, wherever, whenever or however the same may occur. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of North Carolina and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceeding shall be in North Carolina. I affirm that I am of legal age and am freely signing this agreement. I have read this form and fully understand that by signing this form, I am giving up legal rights and/or remedies which may be available to me for ordinary negligence of Carteret County Parks & Recreation or any of the parties listed above. 

    By participating in a program sponsored by Carteret County Parks & Recreation, I grant Carteret County Parks & Recreation the right to use my name, quotes and any pictures taken of me during the sponsored program. 

    *If signing on behalf of minor participant* I have authority to sign for and assume responsibility for all risks to the minor participant named here resulting from participation in the Event. I certify that the minor participant named here is in proper physical condition to participate in the Event and does not have a condition which would impair the minor participants ability to safely participate in the Event. If any claim for personal injury, property damage, and/or wrongful death is commenced on behalf of the minor participant named here against the Releasees, I shall defend, indemnify, and save harmless the Releasees from any and all actions, causes of action, suits, damages, judgements, claims and demands. 

    ALCOHOLIC BEVERAGE POLICY - I hereby, via declaration of my signature, understand and accept that It is unlawful for any person in any park facility to possess alcoholic beverages and/or be under the influence of alcoholic beverages or be disruptive by virtue of such use. Pursuant to Carteret County Code of Ordinances, Article I., In General, Section 11-1.
